Fair Practice Statement
Root Gallery fully endorses and applies the Gallery Fair Practice Code as established by the Dutch Gallery Association (NGA) and required by the Mondriaan Fund. We are committed to transparent, fair, and professional practices in all our relationships with artists, clients, and partners.
As part of our adherence to the Gallery Fair Practice Code:
All agreements with artists are formalised in writing and include clear terms on duration, pricing, possible discounts, and responsibilities regarding transport, insurance, photography, and exhibition costs.
The artist retains ownership of their work until the gallery has received full payment from the collector. In cases of bankruptcy or seizure, this ownership remains with the artist.
Artists receive their share of the sale proceeds within 60 days of the transaction, along with the buyer’s contact details and a copy of the invoice.
Unsold artworks in the gallery’s care will be returned to the artist within one month upon request.
If Root Gallery acts as a primary or exclusive representative for an artist, any collaboration with third-party galleries is based on mutual written agreement.
The gallery maintains professional standards, ensures authenticity of the works sold, and will offer a refund should a work be proven inauthentic by an independent, recognised party.
Our team upholds the broader Fair Practice Code, which includes respectful behaviour and a safe working environment for all parties involved in the arts.
We believe that transparent and respectful collaboration is essential to a sustainable and thriving contemporary art ecosystem.
Artist’s Resale Right (ARR)
Root Gallery prioritises long-term and sustainable relationships between artists and collectors. The gallery aims to place artworks in collections where they are valued and cared for over time.
Root Gallery therefore reserves the right to reconsider future sales or collaborations in cases of speculative short-term resale.
If an artwork is resold by a professional art dealer, applicable resale right fees must be handled in accordance with European Directive 2001/84/EC and relevant Dutch legislation regarding Artist’s Resale Rights.
Upon consultation with Root Gallery and the artist, artworks may also be loaned or exhibited in non-commercial public spaces.
Money Laundering and Terrorist Financing Prevention Act (WWFT)
In accordance with Dutch law, Root Gallery may be required to conduct customer due diligence for transactions of €10,000 or more, including multiple connected transactions.
This process may include:
Verification of identity
Verification of the source of funds
Additional information regarding the nature of the transaction
Collected information will be handled confidentially and in accordance with applicable legal obligations.
